We do not guarantee that every feature will always be available or suitable for every user.
3. Eligibility and Age Requirements
You must meet the minimum age requirement displayed for the Services and be legally capable of entering into a binding agreement.
If our Services are intended for adults aged 18 and over, you must be at least 18 to create an account or use the relevant features.
You must provide accurate information when registering and keep your account details up to date.

Provide accurate and current registration information.
-
Keep your login credentials secure.
-
Not share your account in a way that breaches these Terms or any applicable subscription restrictions.

Notify us promptly if you suspect unauthorised access to your account.
-
Use your account only for lawful purposes.
You are responsible for activity carried out through your account, except where applicable law provides otherwise or the activity results from circumstances for which we are responsible.
We may suspend access where reasonably necessary to investigate suspected fraud, protect account security, prevent misuse or comply with legal obligations. Where appropriate, we will notify you and give you an opportunity to address the issue.
5. Health, Fitness and Medical Disclaimer
Please read this section carefully before following any workout or fitness programme.
FITSYNC provides general fitness information, workout guidance and digital tools intended to support exercise and wellbeing.
Our Services are not a substitute for professional medical advice, diagnosis, treatment or individualised medical supervision.
Unless expressly stated otherwise, we are not providing medical services, physiotherapy, diagnosis or treatment for injuries or medical conditions.
5.1 Your Responsibility
You are responsible for deciding whether an exercise, workout or fitness programme is appropriate for you.
Before starting a new exercise programme, you should consider seeking advice from a qualified healthcare professional if you:
-
Have a medical condition or existing injury.
-
Are recovering from surgery or illness.
-
Experience unexplained pain, dizziness, breathlessness or other concerning symptoms during exercise.
-
Have been advised to limit physical activity.
-
Are unsure whether a particular exercise is safe for you.
5.2 Exercise Risks
Physical exercise carries inherent risks, including muscle soreness, strains, sprains, falls and other injuries. More serious complications can also occur.
You agree to exercise within your own abilities, follow appropriate instructions and stop exercising if you experience pain, dizziness, chest pain, unusual shortness of breath or other concerning symptoms. Seek appropriate medical assistance where necessary.
You should use suitable equipment, appropriate footwear and a safe environment when exercising.
5.3 Results and Individual Outcomes
Fitness results vary between individuals.
We do not guarantee specific outcomes relating to weight loss, muscle growth, strength, endurance, appearance, health or physical performance.
Results may depend on factors including consistency, nutrition, sleep, existing fitness levels and individual circumstances.
Nothing in these Terms excludes liability or consumer rights that cannot legally be excluded.
6. Acceptable Use
You agree to use our Services lawfully and responsibly.
You must not:
-
Use the Services for fraudulent, unlawful or harmful activities.
-
Attempt to gain unauthorised access to our systems, accounts or data.
-
Interfere with the operation, security or performance of the Services.
-
Introduce viruses, malicious code or other harmful material.
-
Copy, reproduce, redistribute, sell or commercially exploit our content without permission, except where permitted by law.
-
Reverse engineer, decompile or attempt to extract source code except where applicable law permits this restriction to be overridden.
-
Misuse another user's information or attempt to access another person's account.
-
Misrepresent your identity or impersonate another person.
-
Use automated tools to scrape, harvest or extract content or data without our permission, except where permitted by law.
-
Use our Services in a way that infringes another person's intellectual property or other legal rights.
We may investigate suspected violations and take proportionate action where reasonably necessary.
7. Subscriptions, Pricing and Payments
Some features may be free, while others may require payment or a subscription.
Before making a purchase, we will display the applicable price, billing frequency, subscription duration and other material terms.
7.1 Subscription Charges
Where you subscribe to a paid plan, you authorise the applicable payment provider to collect the charges you have agreed to pay.
Unless the checkout states otherwise, subscriptions may renew automatically at the end of each billing period until cancelled.
You are responsible for reviewing the price, renewal terms and billing frequency before confirming a purchase.
7.2 Price Changes
We may change subscription prices from time to time.
Where a price change affects an existing subscription, we will provide notice and obtain any agreement required by law or the applicable subscription terms before charging the new price.
If you do not wish to accept a proposed change, you may cancel where permitted by the applicable terms and law.
7.3 Failed Payments
If a payment fails, we or our payment provider may notify you and request updated payment details.
Where payment remains outstanding, we may restrict access to paid features after providing any notice required by law or your agreement.
This does not affect your statutory rights.
7.4 Third-Party Billing
If you subscribe through an app store or another third-party platform, the billing, renewal and cancellation arrangements of that platform may apply in addition to these Terms.
You should review the relevant platform's terms before purchasing.
8. Cancellation, Refunds and Consumer Rights
We want our cancellation and refund arrangements to be clear and fair.
8.1 Cancelling a Subscription
You may cancel your subscription using the cancellation method made available for your purchase, such as your account settings or the relevant app store subscription settings.
Where you purchased directly from FITSYNC, you may also contact hello@fit-sync.co.uk for assistance.
We will provide any cancellation arrangements required by applicable law. Where required, online subscriptions must be capable of being cancelled through a straightforward online process.
Unless otherwise stated or required by law, cancelling a subscription prevents future renewals but does not automatically refund charges already paid for the current billing period.
Your access may continue until the end of the paid period, depending on the subscription terms displayed when you purchased.
8.2 Your Right to Cancel
If you are a UK consumer purchasing online, you may have a statutory 14-day cancellation right for certain contracts.
The rules depend on whether your purchase is a service, digital content or a combination of both.
For digital content supplied immediately, you may lose the right to cancel the digital content contract during the 14-day period if you expressly consent to immediate supply and acknowledge that you will lose that right, where the legal requirements are satisfied.
For services, different rules may apply if you request that performance begins during the cancellation period.
We will provide any required cancellation information and obtain the necessary acknowledgements or consent before relying on an applicable exception.
Nothing in these Terms removes a cancellation right that you have under applicable law.
8.3 Refunds
Refunds will be provided where required by law or where we agree to provide them under an applicable refund policy.
If the Services are faulty, not supplied as agreed or otherwise fail to meet applicable legal requirements, you may have additional remedies under consumer law.
To request a cancellation or refund, contact hello@fit-sync.co.uk and provide your account email address and relevant purchase details.
9. Free Trials and Promotional Offers
We may occasionally offer free trials, discounts or promotional subscriptions.
The duration, eligibility requirements and conditions of each offer will be explained when it is presented.
Where a free trial converts into a paid subscription, we will clearly disclose the applicable price, renewal date and cancellation arrangements before you sign up.
You should cancel before the trial ends if you do not wish to continue with a paid subscription, subject to the terms of the offer and your statutory rights.
We may withdraw or amend future promotional offers where reasonably necessary, subject to any commitments already made to you and applicable law.
10. Intellectual Property
Unless otherwise stated, all intellectual property rights in the Services and their content belong to FITSYNC LIMITED or our licensors.
This may include:
-
Our name, branding and logos.
-
Website and application design.
-
Text, graphics, videos and images.
-
Workout programmes and training materials.
-
Software, code and functionality.
-
Original content, databases and other materials.
We grant you a limited, personal, non-exclusive, non-transferable and revocable licence to access and use the Services for their intended purpose, subject to these Terms and any applicable subscription restrictions.
You must not reproduce, distribute, modify, publicly display or commercially exploit our content without our prior written permission, except where permitted by law.
All rights not expressly granted to you are reserved.
11. User Content and Feedback
If our Services allow you to submit information, comments, reviews, photographs, workout records or other content, you remain responsible for the content you provide.
You must ensure that your submissions are lawful and do not infringe another person's rights.
You retain ownership of any intellectual property rights you hold in your content.
To the extent necessary to operate, maintain and provide the features you choose to use, you grant FITSYNC a non-exclusive permission to host, store, process, display and use that content for those purposes.
We will handle personal information in accordance with our Privacy Policy.
If you provide feedback or suggestions about our Services, we may use those suggestions to improve our products without being obliged to compensate you, subject to applicable law and any separate agreement.
12. Privacy and Personal Information
We collect and use personal information in accordance with our Privacy Policy.
Our Privacy Policy explains what information we collect, why we collect it, how we use it, who we share it with and what rights you may have.
You can review our Privacy Policy at the relevant page on our website.
If our Services process health-related or other sensitive information, additional privacy protections and consent arrangements may apply.
13. Third-Party Services and Links
Our Services may include links to third-party websites, applications, payment providers or fitness platforms.
We do not control all third-party services and are not responsible for their independent content, policies or practices.
Your use of a third-party service may be subject to its own terms and privacy policy.
This section does not exclude any liability we have under applicable law for our own acts or omissions.
14. Availability and Changes to the Services
We aim to provide reliable access to our Services but do not guarantee uninterrupted availability.
Access may occasionally be affected by maintenance, technical issues, security incidents, third-party outages or circumstances beyond our reasonable control.
We may update or modify features to improve functionality, security, performance or compliance with legal requirements.
Where a change materially reduces a paid service or affects your contractual rights, we will act in accordance with applicable law and the terms of your purchase.
If we discontinue a paid service in circumstances requiring a refund or other remedy, we will provide the remedy required by law.
15. Suspension and Termination
You may stop using our Services at any time and may request account deletion through the available account settings or by contacting hello@fit-sync.co.uk.
We may suspend or terminate your access if:
-
You materially breach these Terms.
-
Your use presents a significant security or legal risk.
-
We reasonably suspect fraud or unauthorised activity.
-
We are required to do so by law.
-
We discontinue the relevant Services in accordance with applicable law and our contractual obligations.
Where appropriate, we will notify you of the reason and provide an opportunity to resolve the issue before taking action.
Termination does not remove rights or obligations that arose before termination. Any refund or payment obligations will be determined in accordance with these Terms and applicable law.
Account deletion and subscription cancellation are not necessarily the same process. You should separately check whether your subscription requires cancellation through a payment provider or app store.
16. Limitation of Liability
Nothing in these Terms excludes or limits liability where doing so would be unlawful.
In particular, nothing in these Terms excludes or limits liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or any other liability that cannot legally be excluded or limited.
If you are a consumer, you retain all mandatory rights and remedies available under applicable consumer law.
Subject to the above, we will not be liable for losses that are not reasonably foreseeable consequences of our breach of these Terms.
We are not responsible for a failure or delay caused by circumstances beyond our reasonable control, except to the extent that applicable law provides otherwise.
We do not exclude responsibility for providing digital content or services that meet the standards required by applicable law.
Nothing in this section removes any legal responsibility we owe you in connection with the Services.
17. Indemnity
If you use the Services in a business or commercial capacity, you agree, to the extent permitted by law, to be responsible for losses and reasonable costs directly arising from your unlawful use of the Services or your material breach of these Terms.
If you use the Services as a consumer, this clause does not impose liability on you beyond what is lawful or override your statutory rights.
18. Changes to These Terms
We may update these Terms to reflect changes in our Services, business operations, security requirements or applicable law.
We will update the “Last updated” date when changes are made.
Where a change materially affects your rights or obligations, we will provide appropriate notice and obtain your agreement where required.
If you do not agree to a material change, you may stop using the affected Services and cancel any applicable subscription in accordance with these Terms and applicable law.
19. Complaints and Customer Support
If you have a question, complaint or concern about our Services, please contact:
FITSYNC LIMITED
Email: hello@fit-sync.co.uk
Please include enough information for us to understand your concern and, where relevant, identify your account or purchase.
We will take reasonable steps to review and respond to complaints.
Nothing in this section restricts your right to pursue any legal remedy available to you.
20. Governing Law and Jurisdiction
These Terms are governed by the laws of England and Wales, except where mandatory consumer protection laws in your country of residence provide otherwise.
If you are a consumer, you may be entitled to bring proceedings in the courts of your country of residence or another court with jurisdiction under applicable law.
Nothing in this section takes away any mandatory legal protections available to you.
21. Severability
If any provision of these Terms is found to be unlawful, invalid or unenforceable, that provision will be treated as modified or removed to the minimum extent necessary.
The remaining provisions will continue to apply to the extent permitted by law.
22. Entire Agreement
These Terms, together with any applicable subscription terms, purchase conditions and policies expressly incorporated into them, form the agreement between you and FITSYNC concerning your use of the Services.
If there is a conflict between these Terms and mandatory legal rights, the applicable law and those rights will prevail.
